This Privacy & Confidentiality Policy (“Policy”) is issued by Tristana Ventures Private Limited, a company incorporated under the Companies Act, 2013, having its principal place of business at 105, B Wing, Nisarg CHS, Building No. 78, Tilak Nagar, Chembur, Mumbai, Maharashtra, India – 400089, operating under the brand name “HowUDoin” (“HUD”, “We”, “Us”, or “Our”).
This Policy is formulated in accordance with the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, the Mental Healthcare Act, 2017, and other applicable Indian laws governing the collection, processing, and confidentiality of personal data.
II. APPLICABILITY
2.1 This Policy applies to all individuals (“Users”, “You”, or “Your”) who interact with HowUDoin through its website, online platforms, or physical services, including group therapy, support groups, workshops, and individual therapy
2.2 By accessing, booking, or using any of our services, You acknowledge that You have read, understood, and agreed to this Policy.
III. DEFINITIONS
For the purposes of this Policy:
(a) “Personal Data” means any data relating to an identifiable individual, as defined under the Digital Personal Data Protection Act, 2023.
(b) “Sensitive Personal Data” includes health, sexual orientation, or mental health information.
(c) “Processing” means any operation performed on personal data such as collection, storage, or disclosure.
(d) “Therapist” means a licensed professional engaged or contracted by HowUDoin.
IV. INFORMATION COLLECTION
4.1 We collect the following categories of data:
(a) Personal Identification Data: Name, email address, and phone number.
(b) Service Data: Session type, booking details, date, and time.
(c) Payment Data: Processed securely by third-party payment gateways.
(d) Technical Data: Cookies, browser type, device information.
4.2 We do not collect or store detailed medical or psychological notes via the website
V. PURPOSE OF PROCESSING
5.1 Data collected shall be used strictly for:
(a) Scheduling and managing sessions;
(b) Processing payments and billing;
(c) Communicating service updates or reminders;
(d) Legal and regulatory compliance.
5.2 HUD does not sell or trade personal data.
VI. STORAGE AND SECURITY
6.1 Data is securely stored on cloud platforms and Google Drive, with encryption and limited access.
6.2 Access is restricted to authorised employees and therapists bound by confidentiality agreements.
6.3 In case of a breach, HUD shall notify affected parties and competent authorities within 30 days, per DPDP regulations.
VII. CONFIDENTIALITY OF THERAPY INFORMATION
7.1 All therapists are bound by confidentiality obligations under the Mental Healthcare Act, 2017.
7.2 Confidentiality may be breached only under the following exceptions:
(a) Threat of self-harm or harm to others;
(b) Disclosure mandated under the POCSO Act, 2012;
(c) Legal compulsion under a court or statutory order;
(d) To prevent imminent danger to life or safety.
7.3 Participants in group therapy acknowledge that confidentiality, while encouraged, cannot be absolutely guaranteed due to the nature of shared discussions.
VIII. USER RIGHTS
8.1 Users have the right to access, correct, or delete their data under the DPDP Act, 2023.
8.2 All such requests shall be directed to Team HUD at hey@howudoin.in.
IX. RETENTION
9.1 Data shall be retained only for as long as necessary to fulfil service and legal obligations, not exceeding five (5) years.
X. AMENDMENTS
HUD reserves the right to amend this Policy. The latest version will always be available on our official website.
